Whilst one would expect casualties unidentified in France to be dated post May 10th 1940, enigmatically there are a few from before the start of the attack on France :

At Anzac Cemetery, Sailly Sur La Lys there is an unidentified British Soldier with a date of death of 12-03-1940

And at Cuinchy Communal Cemetery are 3 UBS with graves annotated 1939/1940 which are the only such ones I've ever come across

Without checking them individually I would guess they were killed on the SAAR Front where the BEF was rotating Brigades from January 1940 to get some combat experience against Germans and try and squash German propaganda that the BEF were chatting up French girlfriends whilst French soldiers manned the Maginot Line.

It's not impossible that graves in Northern French cemeteries were lost in the subsequent fighting. I seem to remember something in a diary about a pair being killed in a boating accident too...not sure if the bodies were recovered.

Have you got 2/7 Warwicks diary for 10th Jan, Andy. I'm sure that it would be mentioned if it was an accident.

    Royal Warwickshire Regiment - Wikipedia

The 2/7th and 9th Battalions, both formed in mid-1939 during the doubling of the Territorial Army, were raised as duplicates of the 1/7th and 8th battalions, respectively. Both battalions were assigned to the 182nd Infantry Brigade, 61st Infantry Division. However, both remained in the United Kingdom throughout the war, both briefly serving in Northern Ireland until being reduced to reserve training battalions, with the 9th being disbanded in late 1944

My Father was in this Regiment and was later attached to 182 Inf Bde HQ as a signaller, taking part in Fortitude South deceptions

Have his service records been obtained? - it is possible he was transferred from 2/7th to another regiment of the Royal Warwicks and ended up in France, but only his service records will tell us that.

Another route would be to ask whoever grants permiossion for fallen soldiers to be placed on memorials why in this case was this man accepted for inclusion, there must be a written document somewhere that says 'XYZ............... - yes we accpet him) - who would give that authority??
